FREQUENTLY ASKED QUESTIONS

How much does it cost to form an LLC?

Our flat fee LLC formation service is $1250, which includes the NYS filing fees. If you are a professional service provider, our flat fee PLLC Formation Service varies based on your profession and number of members so please CONTACT US to inquire. If you also want us to publish your new company, the LLC publication and PLLC publication fees depend on your location and are listed at this link. Publication fees vary based upon the advertising fees in your county. We advise publishing your LLC once it is set up since it is legally required, but offer LLC formation and publication services separately in case your LLC is already set up and you just need publishing.

How long does it take to set up an LLC?

We can generally have your LLC set up within 24-hours. Once your LLC is set up, the confirmation paperwork is emailed back to you as soon as possible and you can start running your new business! If you're also publishing the LLC, we start this process right after formation and the LLC publication process takes about 8 weeks. Once the publishing is complete, you receive a second batch of confirmation paperwork.

How long does it take to set up a PLLC (Professional Service LLC)

If you are a professional service provider setting up a PLLC the formation process generally takes about 3 months (unless you are an Attorney, we can do these much quicker). PLLC applications are tricky and must be approved by multiple agencies. The bulk of the processing time is related to obtaining a Certificate of Authority from the New York Department of Education, Office of the Professions. We need their approval in order to get a PLLC set up and they take several weeks to check your professional licensure, review the formation documents for legal sufficiency, etc. If you are an Attorney, the turnaround time is much quicker (usually just a couple of days) because the NYS Bar Association is much quicker at issuing the required Certificates of Good Standing.

Do I need to publish my New York LLC?

New York Law Section 206 says that you do, so we advise complying with the law. Some clients choose to delay the publishing process if they're on a budget because the Department of State tends to monitor the 120 day deadline loosely. Other clients with a higher risk tolerance sometimes choose not to publish, but not publishing can lead to latent problems.

Do I need a Registered Agent in New York?

Third-Party Registered Agents are not required by New York State Law, however our Registered Agent services are popular for many reasons. For more information see our New York Registered Agent Services page.
